This agreement, made this sixth day of January One thousand, eight hundred and fifty eight between William Mclaughlin and Mordecai Bartley of the town of Mansfield in the state of Ohio and Lucy B. Armstrong of the town of Wyandot in the territory of Kansas – parties of the first part, and Gideon Williams and Jacob Moonhouse as Chiefs and Head Men of the Munsee nation of Indians residing in Kansas territory, west of Missouri – parties of the second part – Witnesseth, that the parties of the first part in consideration of the covenants on the part of the parties of the second part hereinafter contained, do covenant and agree to and with the said parties of the second part, to prosecute to final recovery from the United States the claim of the Munsee nation of Indians of their just proportion of the sum of twenty five thousand Dollars, stipulated to be paid to the Stockbridges and Munsees by the treaty of November 24, 1848. Also to recover from the United States certain monies, expended in the emigration of a party of Munsees from the state of Wisconsin to the Indian territory, west of Missouri in 1839. And also to prosecute to final recovery from the United States a claim of forty eight thousand dollars more or less, founded on article 4. of the treaty concluded July 4, 1805. Between the United States and the Chiefs and Head Men of different Indian nations, including the Munsees, at Fort Industry on the Miami of the Lake. – And the said parties of the second part in consideration of the above covenants on the part of the parties of the first part, do covenant and agree to and with the parties of the first part, to pay to said parties of the first part [Page 2] twenty per cent of all the money or monies, which the said parties of the first part or their substitutes may succeed in recovering from the United States in any or all of the above named three claims or any part thereof. – In witness whereof we have hereunder set out hand and seals, the day and year first above written.
