ARTICLES OF AGREEMENT We, the heirs of Robert Franklin Milton, in order to give effect to his expressed wishes hereby agree to the following distribution of said Robert Franklin Milton's properties, both real and personal. It is expressly under- stood and agreed that each of the heirs heretofore named accept the terms of this agreement in contradiction to any right, either real or claimed, to which they are entitled either in law or by virtue of some testamentary document. WHEREAS, Elsie Milton, wife of Robert Franklin Milton, agrees to accept as her complete share of the Robert Franklin Milton estate a good and wumencumbered title to the Blue Springs, Missouri, property. This property being described as that in which she and Robert Franklin Milton have been residing for the past several years; such grant to include the residence house and lot upon whieh it is situated. WHEREAS, all other heirs, namely: James Claude Milton, Mrs. Bess E. Allen, Mrs. Ethel F,. Hughes, and George Franklin Milton hereby stipulate and agree to the following mamer of settlement; That an appraisal of all of Robert Franklin Milton's real property made by John H. Hardin, Robert L. Hood, and Chris Sebolt, and submitted to the afore- named heirs of Robert Franklin Milton on March 7, 1941, shall be used as the financial basis of the division between such heirs. And further, that another appraiser shall be selected by the mutual agreement of the heirs for the specific purpose of dividing the estate for distribution to said heirs named under this article. Bach of such four parcels to be supplemented or diminished as the individual situation of each heir shall require in respect to any debts running from said Robert Franklin Milton to any or all of said heirs, or debts ruming from any or all of said heirs to Robert Franklin Milton. After such determination said heirs agree that their individual parcels shall be selected by lot, according to a plan to be mutually agreed upon.
