University Daily Kansan / Friday, April 10, 1992 13 Doctor who resisted war may lose medical license The Associated Press KANSAS CITY, Kan. — An Army reserve doctor freed from prison after serving eight months for desertion will appeal a decision by the Kansas Board of Healing Arts to try to revoke, suspend or limit her license, her attorney said yesterday. State legal proceedings to rescind the medical license of the doctor, Yolanda Huet-Vaughn were initiated the day after she was freed from the U.S. Disciplinary Barracks at Fort Leavenworth. The Kansas Board of Healing Arts filed a petition Tuesday seeking an evidentiary hearing on whether to revoke, suspend or limit Huet-Vaughn's license. The board voted in October to seek a hearing. "I had hoped everything was going to die down and they weren't going to do anything," said Donald Strole, Huet-Vaughn's attorney. "It itse the only reason they are doing this is for punitive reasons," Strole said. "The Army has already punished her and believes it has punished her enough." Strole said he would file a motion to dismiss the board's petition on the grounds it involved various procedural and legal irregularities. He questioned whether the board had the authority to discipline a doctor based on a court-martial, which he said is equivalent to being fired from a police or fire department. "It's an internal disciplinary thing," he said. "This is not a felony as contemplated by the statute." Huet-Vaughn was court-martialed last year for refusing to serve in the Persian Gulf War. She said she believed the war was immoral, inhuman and unconstitutional. The Army secretary granted her clemency from her 30-month sentence Monday. She said yesterday that she was surprised when told of her release and did not know why the decision had been made. She also said she did not know of the board's action until a reporter contacted her office Tuesday. The Kansas medical board said it took the action against Hue-Vaughn, a family physician, because she was a convicted felon and because she displayed unprofessional conduct. Those are both actions that make her liable to board discipline, the board said. "My own personal belief is she should have a revoked license, and when she paid her penalty, then she can come back and ask for the license to be reinstated," said Rex Wright, board vice president, in August. When asked Wednesday about the case, Wright said, "There are things that might change my mind altogether after I hear more details."
