Before the ruling, real estate development involving new streets and utility services had to be approved by the Lawrence City Commission in approval of the appointed Lawrence-Douglas County Planning Douglas. However, King ruled that a city ordinance allowing the city commission to deny rights of way for utilities going into property, conflicted with a 1965 state law.
