Wednesday, November 14, 1979 Truant girl told to enroll 5 By KATE POUND Staff Renarter A Douglas County juvenile may be placed in a detention center if she is not enrolled in a school by tomorrow, the child's mother, Donna May Flr. Rt. 5, said yesterday. Douglas County juvenile court officials, Phil Burdick, attorney for the child, refused to comment on the case because the county courts are not open to the public. The 15-year-old girl was threatened with placement in a foster home or juvenile detention center during a Douglas County juvenile court hearing on Monday, Fliary said. The girl, who would have been in the county, also had been suspended for religious reasons. Fliary said. "She has made a decision to stay out of the school and she is willing to be responsible for her decision." Flory said. According to Flery, her daughter objects to attending Lawrence public schools because of alleged "sex and drugs in the school's environment." "WE DONT OBJECT to education. In fact, I imagine that she will later go on to take her G.E.D. so that she can study nursing or something useful." Fliary said. The G.E.D. is a high school diploma equivalency examination, given to persons who have failed to finish the 12th grade. Lawrence School District 497 officials had filed a truancy report with the Douglas County juvenile court in late October. Carl Knox, district superintendent, said. A 1965 Kansas law requires juveniles under the age of 16 to attend school full time. o to attend school on time. However, according to Flory, she and her daughter had asked for a waiver from the Kansas Compulsory Education Act. "I gave Carl Knox the forms and he said we had nothing to worry about." Flory said. KNOX SAID that waivers to the Compulsory Education Act were given on religious grounds, but that he had not received a waiver application from the girl. Wavie applications, he said, are not handwritten. He said he directly to the state Board of Education. According to David Kester, legal counsel for the state Board of Education, parents must guarantee that an alternate form of education will be given their children. FLORY, formerly a member of the Old Order German Baptist Brethren, known locally as Dunkers, she did not apply for the waiver as part of a religious group. According to Flory, the Order does not oppose public education and many of the group's children attend public schools.
