12 University Daily Kansan Second Section Monday, Aug. 26, 1985 Glickman explores chances of taking Dole's Senate seat The Associated Press TOPEKA — Congressman Dan Glickman last week that he still was considering challenging Robert Dole for his U.S. Senate seat in 1986, but that his "inclination" remained to seek re-election to the House. Glickman said during a visit to the Capitol that he would be waging a massive political war at a distinct financial disadvantage if he were to go after Dole's Senate seat next year. "It's going to be a challenge," Republican senator was vulnerable. Glickman, a Wichita Democrat said he thought Dole could be beaten on the issues of his acceptance of large amounts of money from special interest groups and his continued strong interest in seeking the GOP nomination for president, which Glickman said came at the expense of Dole's paying too little attention to Kansas. Gickman said he expected to make his decision whether to seek the Democratic nomination for the Senate or seek re-election sometime this fall, possibly as early as next month. He has no deadline, he said, for making up his mind. "My inclination is to run for re-election, but I'm going to look at it (a Senate race) some more," the five-term congressman said. "I'm going to keep my ear to the ground, and do some more polling before I make the final decision." Glickman said he was virtually certain he would remain in elective office, ruling out the possibility he might retire from politics or take a shot at Dole even if it meant certain defeat. He refuted recurrent rumors that he is tired of being in the U.S. House. "I don't want to get out of the political system" he said. "I presume I will run for re-election if I don't take one of these other choices available to me. Running for the Senate or for re-election are the two realistic choices for me right now. My interest remains in federal legislation." Glickman has in the past eyed a possible race for Democratic nomination for governor, but virtually conceded that to Lt. Gov. Tom Docking, also of Wichita. He said he had been exploring his fundraising prospects. "The conventional wisdom is, I would have to raise a very large amount of money to compete with Senator Dole, who has access to virtually unlimited caches of funds," said Gickman, a 40-year old attorney who first was elected to the U.S. House in 1976. "I believe all Republicans are vulnerable, but I would be outspent three, four, five times, at least. The question I have to ask myself is, even with that vulnerability, do I need millions of dollars for a campaign, or can I run an imaginative race that doesn't require those obscene amounts of money? "The other question is whether the public is ready for a campaign where big, special-interest money is an issue — buying votes. To date, nobody has won a campaign making money the issue. But my gut feeling is Kansans are ahead on this issue and might respond to a campaign based on money being the main issue." Glickman said Dole could and had tapped the big political action committees for huge amounts of money, and could get almost any amount he needs for a campaign. "I think that's an issue," Glickman said. "I've always been concerned about the funding of our campaigns and have always felt there should be spending limits. I think I would set a limit on my own spending, and then make that an issue." The other issue on which Dole is most vulnerable, Glickman said, is his interest in the presidency. "I'm very much aware of the premise that Bob Dole wants to be president of the United States very badly," he said. "Therefore, Bob Dole will do anything he can to defeat me or anybody who challenges him, to remove that impediment in 1986. "But this state has some extremely serious problems — more serious than anything since the Great Depression. The environment that existed for 50 years is rapidly deteriorating. The economy is slipping and the population is not expanding. "I like to think of myself as a fighter for Kansas first. Being majority leader of the Senate, you just can't focus on those issues exclusively as you should, especially if you're running for president as well." RICHMOND, Va. — A law professor predicted last week that companies faced with crushing damage claims would increasingly seek protection in bankruptcy courts, as the A.H. Robins Co. has done to shelter itself from suits involving a faulty birth control device. From Kansan wires "It's an option that is filled with many problems and potential dangers," said Victor Schwartz, author of "Schwartz on Torts." Sued firms may seek bankruptcy "But I think the important thing now is that it is an option." The pharmaceutical firm said it took the step because of the unknown costs of setting another 5.100 pending cases. Robins, which with its insurer has paid $78.3 million to settle 9.230 claims over its Dalkon Shield intrauterine device, filed Wednesday for protection from its creditors who reitize organizers. The National Women's Health Network filed a legal challenge last week to the company's attempt to get bankruptcy protection. It entered a motion in U.S. District Court in Richmond to dismiss as unwarranted the pharmaceutical giant's petition to reorganize under bankruptcy laws, "This is not a genuine debtor seeking relief from a genuine creditor, but a company that is trying to be protected from women it knowingly injured," said Aaron Levine, an attorney representing the women's group. Lawyers representing women in suits against Robins disagreed last week on the effect of the filing. "The bankruptcy petition was unjustified. This company is not bankrupt by any means," said attorney Bradley Wall of Wichita. Robert, Manchester, a Burlington, Vt., attorney who represents 500 claimants, said "the bankruptcy process will help us accomplish our ends," although he would have preferred trying the cases. Their comments came after a lawyers' conference before U.S. District Judge Robert R. Merhige Jr., who has handled dozens of Dalkon Shield cases. Those cases were put on hold by the bankruptcy filing. The Denver-based Manville Corp. set the precedent by filing for bankruptcy three years ago, saying it would be wiped out by the $12 billion in claims filed by individuals injured by exposure to the asbestos it produces. Manville has proposed a $2.5 billion compensation plan. Schwartz said the Robins case differed from Manville's because the Denver firm faced virtually unlimited claims. The number of people exposed to asbestos is unknown and years can elapse before the ill effects of exposure are evident.
