Nation/World University Daily Kansan / Friday, November 6, 1987 9 Man arrested for burying his pet dog to teach it not to run away from home The Associated Press CLEVELAND — A man who ran away from police when they stopped him from burying his dog alive has been charged with cruelty to animals and resisting arrest, police said. The man, who lives in suburban Eastlake, was attacked by a police dog and received a minor bite when he attempted to escape, William DePledge, Eastlake police chief, said Wednesday. Neighbors reported Tuesday "T The dog was raising quite a ruckus. — William DePledge Eastlake police chief that Frank Roadman, 24, was beating his dog with a shovel while attempting to bury it alive in his front yard, DePledge said. "The dog was raising quite a ruckus." DePledge said. "He said he was trying to teach the dog a lesson. He said he was going to teach the dog to stay in the yard by burying it up to its head and leaving the head above ground." Police who responded found a 1-year-old, mixed-breed German shepherd buried except for its head and front paws, said detectives. The animal apparently was in shock when extricated by police. Doyle said. Police were unable to approach the animal after it was freed, but Doyle said Lake County Humane Society officials had been called to care for it. A preliminary hearing has been scheduled for Nov. 17 on the dog cruelty charge. Roadman is scheduled to stand trial Monday on another charge. He allegedly helped another man abduct a woman outside a bar in Willoughby, said prosecutor John Shoop. Roadman had been released from Willoughby Municipal Jail on $1,000 personal bond New trial granted in tainted bread case The Associated Press TOPEKA — The Kansas Court of Appeals ordered a new trial Wednesday on behalf of a Wichita prizefighter who filed suit against Safeway Stores Inc. after he purchased a loaf of bread that allegedly had a needle in it. The appeals court ruled that Sedgwick District Judge Hal Malone committed errors in the instructions he gave to the jury when Robert Hazel- ton sued Safeway. The jury ruled in favor of Safeway. According to court records, Hazelton's father-in-law bought a loaf of bread at a Wichita Safeway store on Sept. 27, 1983. Hazelton apparently ate a sandwich and felt something scratching his throat and spit out a pin. He told his wife to call the police, the appeals court opinion said, but later in the day he had stomach cramps and vomited blood. The following day X-rays were taken that showed Hazelton, a heavyweight boxer, had a pin in his intestines. It surgically was removed. The appeals court ruled that the judge committed a reversible error by instructing the jury that Hazelton had the burden to prove a needle was in a loaf of bread when it was "manufactured" instead of "time of sale."
