University Daily Kansan / Thursday, November 5, 1987 Campus/Area 9 State settles suits against University Med Center patient to get $250,000 By a Kansan reporter The settlements of two lawsuits, one involving a University of Kansas employee and the other involving a KU Medical Center patient, were approved Monday by the State Finance Council, a spokesman for the state attorney general's office said this week. The council approved a $250,000 settlement to the family of Kimberly Borland, a 17-year-old girl now in a coma at the Med Center. The suit, filed in March 1986 in Wyandotte County District Court, alleged that the coma resulted after the girl jumped or fell from a window in her room in the Med Center. The Med Center was added filling to place screens or covers on the outside of the windows. The girl was brought to the hospital in April 1985 with a head injury she had received in a car accident. Fenstemaker, a 35-year veteran of Parking Services, fitted suit against KU on June 10, 1986, in Douglas County District Court, alleging age discrimination, according to court documents. The Finance Council also approved a settlement of $9,000 to Edwin Fenstemaker, a KU Parking Service employee. The suit also contended that psychological force had been used to coerce Fenstemaker into accepting his demotion. Fenstemaker contended in his suit that he was demoted from lieutenant to patrol officer, two levels, because of his age. Fenstemaker originally was seeking more than $100,000 in puneit damage and back pay, according to documents.
