The county argued that the election was not binding and that it was simply advisory. The lawsuit, which contends the county asked an unfair and biased question on the ballot during the last week of January, was filed by Sr. Tommy Miller and Paddy Bower. County Commissioner Mark Buhker said the commissioner would ask the Supreme Court to hear the case. He added that the most efficient way to settle the matter. The commission had the option either to send the case to the Supreme Court or to send it back to Douglas County District Court. Douglas County District Judge Mike McKinnon cases against the county in December However, the Kansas Court of Appeals ruled in favor of the plaintiffs earlier this month. Chris McKenzie, county administrator, said the case would be ended if the Supreme Court heard the case and decided in favor of the county. If the Supreme Court hears the case and agrees with the appeals court decision, the case will be sent back to Douglas County District Court, he said. McKenzie said the county already had spent $600,000 on the project and planned to spend a total of $1.1 million by the end of the year. Douglas County residents, said that he would have made the same decision if he were a commissioner but that he thought the commission was delaying the case by asking the Supreme Court for a review. He said it was highly possible that the Supreme Court would not even hear the case. "The Supreme Court rejects many more petitions for review than it accepts," Strolesaid. If the Supreme Court decides to hear the case, it might not be heard for another six to nine months, Stroble said. He said the Supreme Court would decide in December or January whether it would hear the case. He said the plaintiffs eventually would like to see the citizens vote about the trafficway on an unbiased question on a new ballot. Yugoslavian warplane drops bomb on Hungarian village near border The Associated Press BELGRADE, Yugoslavia — A Yugoslav warplane dropped a cluster bomb on a Hungarian village, spilling violence from Yugoslavia's 4-month civil war over the border. Four weeks of shelling by the army has left the city of 50,000 people without power and with little drinking water. - Croatian officials reported fighting in several parts of Slavonia, an ethnically mixed region in eastern Croatia that has been the scene of fierce fighting since Croatia declared independence along with Slovenia on June 14. Germany and Belgium said they would propose that the European Community order economic sanctions against Serbia and the Yugoslav federal government. "It appears clear to us now that Serbia and the federal government are blocking the whole peace process," the Foreign Minister Mark Eyskens said. The announcement of the Barcs bombing came the same day that Hungarian Prime Minister Jozsef Antall asked NATO to protect Eastern Europe's fledgling democracies from attacks. It was unclear whether the incident was connected to Antall's plea, which was made in a visit to the headquarters of the North Atlantic Treaty Organization in Belgium. Col. Gyroergy Keleti of the Hungarian Defense Ministry told Hungary's state radio that Bares, on the border with Yugoslavia, was hit Sunday by a cluster bomb, which is designed to spew hundreds of lethal pellets. Hungary's state news agency MTI quoted Bares Mayor Lajos Bencze as having said that there were no injuries but damage was serious in his village, and was more than 40 miles from any previous Yugoslav air attacks in Croatia. The incident was likely to worsen already tense relations between Yugoslavia and Hungary, which has claimed repeated violations of its airspace by Yugoslav air forceplanes. Serbia, Yugoslavia's dominant republic, and the federal military have accused the Hungarians of aiding Croats in their war with the Yugoslav army and Serb rebels in Croatia. The Hungarians reported the bombing the same day the foreign ministers of Serbia and Hungary met in Budapest to try to patch up past differences. Officials said they wanted the bombing confirmed before making it public. Serbia increasingly has assumed the functions of Yugoslavia's moribund federal government during the secession crisis. Croatia said Sunday that 5,000 people have died in fighting in the secessionist republic.
