Class materials scarce in wake of decision involving Kinko's By Alexander Bloemhof Kansas staff writer Class materials have become more expensive and less accessible for KU students since Kinko's Graphics Corporation lost a lawsuit last spring. "The main thing I've noticed is it' much harder to get the reprints done," said Tim Miller, assistant professor of religious studies. "It has been actually an access problem more than a money problem." Because of the lawsuit, which was decided May 28, Miller did not get some of his course materials in time for the fall semester. he said. Eight publishers sued two New York City Kinko's stores for selling course materials to college students without getting permission for the use of copyrighted materials. The parties involved signed an agreement Oct. 17 that said Kinko's would accept the decision, seek permission for the use of copyrighted materials and pay $1.875 million in damages, said Judith Platt, director of communications for the American Association of Publishers, which coordinated the case. Miller said that he did not use Kinko's this fall as much as in previous semesters. He now puts materials on his desk; students can copy them on their own. "It was really convenient from the teacher's point of view," Miller said. Adrianna Foss, vice president of operations for Kinko's Service Corp. in Ventura, Calif., said business for all four companies would be 10 percent since the court decision. "But most professors have been really understanding about the changes and accepted them," Foss said. She said Kinko's had printed copyright material without getting permission under the fair-use clause of the Copyright Act of 1786 before the court decision. The fair-use clause allows materials to be copied without permission from the copyright holders for the purpose of criticism, comment, news-reporting, research and scholarship and research, said Rose Marino, associate general counsel at KU. Foss said that in the past, Kinko's had not asked for publishers' permission to copy materials that fell into fair-use guidelines. Mario said several factors had to be considered to determine whether the problem was a true case. "As a result of the judge's ruling, commercial copy centers like Kinko's cannot use the fair-use clause anymore," she said. Such factors include the nature of the work, the amount and substantiality of what is copied, how the copying would affect the market value of the work and whether the use is commercial. The copies disputed in the lawsuit were from hardback and paperback textbooks. The copies ranged in length from 140 to 110 pages. "They were making a profit from this," Marino said. "I think it was a matter of time until they got caught because they were so excessive about it."
