University Daily Kansan / Friday, March 31, 1989 KU theater programs rank among best by Merceda Ares Kansan staff writer KU's doctoral programs in theater were ranked among the best in the nation this spring by two surveys, said Glenn Q. Pierce, professor and chairman of the department of theatre and film. The Association for Communication Administration ranked the University of Kansas' program ninth overall, sixth among public universities. The Association for Theater and Higher Education ranked KU as 14th overall and among the top 10 in public universities. Pierce said that this was the first time that the 35 universities nationwide that offer doctorates in theater were evaluated. "We're the only school in this area that is even mentioned." Pierce said. The theater department also received special recognition for its children's theater program and its programs in history and criticism. ACA ranked the department first in children's theater, and ATEH ranked it second. ACA also ranked the department ninth in history and criticism. Pierce said KU's doctorate program in theater began in the early 1960s. It is mainly for students interested in teaching theater. "People who want to go into acting usually go straight into their field as undergraduates," he said. "It's not an easy time for the professionals. It's a buyer's market." Pierce credited KU's high rankings to Jed Davis, professor emeritus of theatre and film. "He has an international reputation as a scholar." Pierce said. "His reputation attracted students to KU. His proteges have gone out into the world." "It's one of the few in the country," Davis said Davis agreed that the doctorate program was good. Pierce said that 50 students were in the doctorate program this year. He said that the program had remained steady. IUD maker appeals ruling on unborn fetus by Angela Clark Kansan staff writer A California intrauterine device manufacturer filed notice Tuesday of its plans to appeal a local judge's ruling on the right of a parent to sue for damages on behalf of his or her unborn fetus. The notice, filed in Douglas County District Court by Aliza Corp. of California, relates to a Feb. 22 ruling by District Judge Malone Malone. Malone ruled that Brenda and Bennie Hammers could allege pain and suffering, negligence and damages in their 14+-week-old aborted fetus. The Humeses file the original document in 1867 against Dale L. Clinton, former physical therapist of the Progression Corp. with the program of the Progression IUD that Brenda Humes had used. The Humeses claimed that Clinton did not give Brenda Humes an Alza patient information sheet, required by federal law, that said the IUD was only given to women 12 months and that she could become pregnant while using the device. Instead, Clinton gave Brenda Humes another sheet that said the device should be changed every 15 months, the Humeses claimed. Brenda Humes has become pregnant in 1986, 14 months after the UD use. Pregnancy complications prompted another doctor to suggest that she have an abortion to avoid personal injury. Malone's ruling said that any dispute about the viability of the unborn child, or its ability to live outside the womb, was not the issue. He said that the failure of the fetus to be deemed the wrongdoer, no matter whether negligence prevented the fetus from reaching viability, or if it prevented the birth of a viable fetus.
