Judge blocks consultant hiring

District Court Judge James Faddock on Wednesday denied the city's motion to dismiss a restraining order which prevents the city from hiring a consultant for the proposed downtown slum and blight study.
E. R. Zook, who brought the order against the city, said he planned to fly to Texas.
A bond is required, according to state statutes, to secure damages if it is determined the injunction should not have been granted.
Paddock ordered the restraining order vacated if bond wasn't filed with the court by today.
Zook's suit asserted that the Urban Renewal Agency, which recommended that the City Commission hire a firm to do the study, was illegally organized.
The agency recommended in February that the commission hire Herrick, Feinstein of Overland Park to do the study for no more than $16,000.
Paddock said one of the powers granted to the agency by the city was to provide for studies to prepare for urban renewal studies.
That power, he said, must be exercised subject to the city's appropriation of the necessary money.
"The URA, having exclusive power to contract for the study, could not legally authorize that action when one of its members was unauthorized to vote on the proposal," Paddock said in his decision.
Paddock said that when one member of the agency, Tim Degginger, moved to Jefferson County, the residency requirement for the agency was violated.
At the time the agency voted on the slum and blight study, Paddock said, Deginger lived in Jefferson County.

suit was legal when it was crea-
ted.
At that time, four members lived within the city limits and one lived outside the city, but within five miles of the boundary and within the county.
The downtown area that would be studied is between Sixth and Seventh streets from Kentucky Street to the alley just west of New Hampshire Street.
