Swarts requires the written complaint, she said, to discourage tenants from just harassing the landlord. By Peggy Kramer Kansan Magazine writer Students should be aware of their rights and responsibilities as tenants before renting an apartment or house. If their rights are ever violated, students should also know where they can get advice and assistance. Tenants with complaints may call or write Swarts at city hall or Cynthia Harris, consumer services specialist, at the Consumer Fred McEhlene, KU director of residential programs, said his office offered a consumer's guide and information on tenant-landlord relations. But he said the office dealt primarily with on-campus housing and got a minimal number of complaints from residents who lived off campus. The Rental Housing Handbook and Kansas Residential Landlord-Tenant Act contain information on leases, landlord obligations, tenant responsibilities and housing and building codes. The Rental Housing Handbook states that both the tenant and landlord share the responsibility for maintaining a decent dwelling and a good rental relationship. If a problem does violate the law, a tenant could first send a letter to the landlord asking that the violation be repaired. If the landlord doesn't respond, the tenant should write Swarts and she will inspect the property. In Lawrence, several older houses have been converted into apartments and present special concerns for their residents. Margene Swarts, minimum housing and environmental inspector for the city, said one common problem in older houses was the electrical system. Because older houses have fewer electrical outlets, she said, the tenants must use more extension cords. This increases the chance for electrical fires or blown fuses. Swarts handles building code violations and enforces the housing standards listed in the 1979 Edition of the Uniform Housing Code, which lists the minimum standards for existing buildings. If tenants think housing codes have been violated, they should read the Rental Housing Handbook and the Kansas Residential Landlord-Tenant Act to see whether they have the legal right to complain. "There are certain codes that are just common sense, such as fire extinguishers and pest control," said Wallace. Harris said complaints that concerned the health and safety of tenants were referred to the city inspector. The Consumer Affairs Association acts as a mediator between the consumer and landlord for smaller problems such as improper function of appliances. Swarts investigates an average of one complaint a week regarding both old and new buildings. Swarts said landlords usually were given a time limit of 30 days in which to complete repairs on a building. But if the landlord makes progress on the repair, Swarts said, she will extend the time limit. Wallace said, "Some houses are really falling apart and it is economically impossible to fix them. Some of the houses that were abused in the late '60s and early '70s are now being torn down." "There are some target neighborhoods, such as east Lawrence and Oread, where the vast majority of complaints originate," Swarts said.
