Constance is dismissed as defendant City Commissioner Dennis Constance has been dismissed as a defendant in a lawsuit over the city's refusal to rezone 61 acres for a suburban mall. Constance also is manager of Oliver Hall. by a Kansan reporter manager of the suit, filed by developers Jacobs, Discorsi and Jacobs of Cleveland and two landowners, that constance conspired with other defendants to prevent development of a regional shopping mail that would compete with downtown businesses. The ruling last Tuesday by Douglas County District Judge James W. Paddock denied that Constance violated the Kansas antitrust laws. The plaintiffs based their claim on statements made by Constance when he was a candidate and after he was elected to the city commission. Also at issue were statements Constance made and actions he took as a member of the Downtown Improvement Committee. meen commission Paddock ruled to dismiss the city-county planning commission as a defendant in the JVJ lawsuit. Paddock also rejected five additional claims in the lawsuit. Because of a reporter's error, the university where Horowitz earned her doctorate in developmental psychology was incorrectly identified. She received the degree from the University of Iowa.
